Who we are
Pogun is a project of Input Output Global, Inc. (“IOG”, “we”, “us”), 2015 Ionosphere Street, Suite 201, Longmont, Colorado 80504, USA. These terms govern this website and its waitlist. By using the site you accept them; if you use it on behalf of an entity, you represent that you have authority to bind that entity.
What this site is
This site describes a product in development and collects waitlist entries for it. Nothing here is an offer, a solicitation, or an invitation to enter into any transaction, and nothing here is investment, legal, accounting or tax advice. Reading this site, or joining the waitlist, creates no client or advisory relationship.
Eligibility
You must be at least the age of majority in the jurisdiction where you live to use this site or join the waitlist. By using the site, you represent and warrant that you are not the subject of, nor located or resident in a country or territory that is the subject of, any economic or trade sanctions, and that your use complies with applicable export control laws.
Waitlist
Joining the waitlist means leaving an email address and, if you choose, answering a few optional questions. It creates no obligation and guarantees no product access. We may invite people from the waitlist at our discretion and may decline or defer access without giving a reason. You can leave it at any time by asking us to delete your entry — the privacy page says how.
Figures on this site
Figures on this site are records, not promises. Market and third-party figures identify the source or reference date shown with them. Figures from Pogun’s own test runs — transactions, sizes and fees — describe public-chain activity on the dates shown. None is a forecast or a term you can transact on: the product’s actual terms will exist only in the agreements that create them, once there is a product to sign.
Panels marked illustrative are exactly that: worked examples, not published offers.
Your use of the site
You agree not to:
- use the site to facilitate any violation of applicable law, rule or regulation;
- infringe intellectual property rights, impersonate any person, or misrepresent an affiliation with IOG or Pogun;
- reproduce, duplicate, copy, sell, resell or otherwise exploit any portion of the site or our materials for commercial purposes;
- interfere with the site’s functionality, introduce viruses, worms or similar harmful code, attempt to gain unauthorized access, probe for vulnerabilities, or impose an unreasonable or disproportionately large load on its infrastructure;
- scrape the site’s data or use its contents to train artificial-intelligence models;
- submit other people’s email addresses to the waitlist form or the contact form.
Our materials
All right, title and interest in and related to this site — its content, design, illustrations and code, including all related intellectual property rights and the licensed typefaces — is the exclusive property of IOG or its licensors. We grant you a limited, non-exclusive, revocable, non-transferable license to access and view the site for personal, non-commercial use. IOG and its licensors retain exclusive ownership of the Pogun and IOG names, logos, marks and graphics; you may not use them in public-facing materials without our prior written consent, and you may not remove or obscure any proprietary notices.

Notices under the Digital Millennium Copyright Act go to DMCA@iohk.io, or by mail to the legal department at the address in the first section, with the elements the DMCA requires.

The site describes work in progress: we may change, pause or remove any part of it, including the waitlist, at any time and without notice.
Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IOG AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, LOSS OF PROFITS OR REVENUE, LOSS OF BUSINESS, BUSINESS INTERRUPTION, REPUTATIONAL HARM OR LOSS OF DATA ARISING FROM USE OF, OR RELIANCE ON, THIS SITE, AND OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED USD $100. These limits do not apply to fraud or willful misconduct, or where they are precluded by applicable law.
Indemnification
You will indemnify and hold harmless IOG and its affiliates from claims, damages and expenses (including reasonable attorneys’ fees) arising out of your breach of these terms or your violation of applicable law in connection with the site.
Dispute resolution
If a dispute arises, write to legal@iohk.io first: the parties will try in good faith to resolve it informally for sixty days. After that, any dispute will be resolved by final and binding arbitration administered by JAMS in New York before a single arbitrator, except that either party may bring qualifying claims in small-claims court or seek injunctive relief for intellectual-property misuse. You and IOG each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by writing to legal@iohk.io within thirty days of first accepting these terms.
Governing law
These terms are governed by the laws of the United States and the State of New York, without regard to conflict of laws principles. If the arbitration agreement is found unenforceable, the federal or state courts located in New York County have exclusive jurisdiction.
Changes and termination
We may suspend or terminate access to the site at any time, and we may change these terms at any time: when we do, the date at the top moves, a material change will be flagged on this page rather than slipped in, and your continued use constitutes acceptance. Provisions that by their nature should survive — ownership, disclaimers, liability limits, dispute resolution — survive. The English version of these terms is binding.
